These Terms of Service ("Terms") govern your use of Car Show Expert ("the Service"), operated by Alan Macfarlane ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. The Service
Car Show Expert is a software platform that helps car show organisers manage registrations, check-in, judging, voting, and results. We provide tools — the organiser is responsible for running their event and for their relationship with entrants and attendees.
2. Accounts
To use the organiser dashboard you must create an account. You agree to:
- Provide accurate information when signing up
- Keep your password secure and not share it with others
- Notify us immediately if you suspect unauthorised access to your account
- Be responsible for all activity that occurs under your account
You must be at least 18 years old to create an account.
3. Acceptable use
You may use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to collect, store, or process data in a way that violates applicable law
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Transmit malware, spam, or any harmful or deceptive content
- Scrape, copy, or redistribute any part of the Service without our written permission
- Use the Service in a way that could damage, disable, or impair it
- Impersonate another person or organisation
- Use the Service for any illegal purpose
4. Your data and your responsibilities
When you use Car Show Expert to run a show, you collect personal data from entrants (names, emails, vehicle details). In that context:
- You are the data controller for registrant data; we process it on your behalf
- You are responsible for informing entrants how their data will be used
- You must not use registrant data for purposes unrelated to operating your show
- You must not sell or share registrant data with third parties without entrants' consent
Our Privacy Policy explains how we handle data about you as an account holder.
5. Plans, billing, and cancellation
Free and Standard plan
The Standard plan is free. Basic shows are included at no cost. Expert shows can be purchased on a per-show basis. Per-show upgrades are non-refundable once the show has been upgraded.
Pro and Enterprise plans
Pro and Enterprise are subscription plans billed monthly. Subscriptions renew automatically until cancelled. You can cancel at any time from the Settings page — your plan remains active until the end of the current billing period.
Refunds
We offer refunds at our discretion. If you believe you were charged in error, contact [email protected] within 14 days of the charge.
Price changes
We may change our prices. We will give you at least 30 days' notice before a price change takes effect for existing subscribers.
6. Intellectual property
The Car Show Expert platform, including its design, code, and content, is owned by us and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our intellectual property.
You retain ownership of any content you upload or create through the Service (show descriptions, class names, etc.). By uploading content, you grant us a limited licence to store and display it as necessary to operate the Service.
7. Third-party services
The Service integrates with third-party providers including Stripe (payments) and Resend (email). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
8. Availability and support
We aim to keep the Service available and running well, but we don't guarantee uninterrupted availability. We may perform maintenance, fix bugs, or make changes that temporarily affect access. We'll try to give advance notice of planned downtime where possible.
Support is provided by email at [email protected]. We aim to respond within one business day, though we don't guarantee response times.
9. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We don't warrant that the Service will be error-free, uninterrupted, or meet your specific requirements. Use of the Service is at your own risk.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service — including loss of data, loss of revenue, or loss of goodwill — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from the Service will not exceed the amount you paid us in the 12 months before the claim arose, or $100, whichever is greater.
11. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
12. Termination
You may stop using the Service and delete your account at any time from the Settings page.
We may suspend or terminate your account if you violate these Terms, if we reasonably believe your use puts others at risk, or if required by law. We'll try to give advance notice where possible, except in cases of serious or repeated violations.
On termination, your right to use the Service ends immediately. We'll delete your personal data in accordance with our Privacy Policy.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.
14. Governing law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
